Nothing in these terms limits the rights you have as a consumer under Dutch or European law.

SECTION 1. USING OUR STORE

By agreeing to these terms, you confirm that you are at least 18 years old, or that you have permission from a parent or guardian to use this website.

You may not use our products or website for any illegal or unauthorised purpose, and you may not break any laws in your country while using our website. You must not send any viruses, harmful code or anything else designed to damage or interfere with our website.

If you break any of these terms, we may stop providing our services to you.

SECTION 2. GENERAL CONDITIONS

We may refuse service to anyone at any time if we have a valid reason to do so, for example in case of suspected fraud or misuse of our website.

Your payment details are always encrypted and handled securely by our payment providers. Other content you send to us may pass over different networks and may be adjusted to meet the technical requirements of those networks or devices.

You agree not to copy, sell, resell or use any part of our website, its content or our products for commercial purposes without our written permission.

SECTION 3. INFORMATION ON OUR WEBSITE

We do our best to keep the information on our website accurate and up to date. Still, some information may occasionally be incomplete or out of date. The material on this site is for general information only, and any reliance on it is at your own risk.

We may update the content of our website at any time, but we are not obliged to do so.

SECTION 4. OUR PRODUCTS

Brunetix sells artificial plants, decorative greenery, planters and home decor pieces for indoor and outdoor spaces.

We take great care to show the colours, sizes and details of our products as accurately as possible. Because screens differ and many of our products are shaped and finished by hand, the product you receive may look slightly different from the photos. Small differences in colour, shape or leaf arrangement are normal and do not count as a defect.

Some practical notes about our products:

Our artificial plants are decorative items and are not meant to be eaten. Please keep small parts away from young children and pets.

Artificial plants and decor items should be kept away from open fire, candles and other heat sources.

Products used outdoors may slowly fade over time due to sunlight and weather. Where a product is suitable for outdoor use, we mention this in the product description.

Some products may only be available in limited quantities. We may limit the number of products we sell to any person or household, and we may stop selling a product at any time.

SECTION 5. PRICES AND CHANGES

All prices on our website are shown in euros and include VAT (BTW). Shipping costs, if any, are shown separately at checkout before you place your order.

We may change our prices at any time. The price that applies to your order is the price shown at the moment you place it. Price changes after that moment will not affect your order.

We may change or discontinue any part of our website or product range at any time.

SECTION 6. ORDERS AND PAYMENT

When you place an order, you will receive a confirmation email. A contract between you and Brunetix is formed once we confirm your order.

You can pay using the payment methods shown at checkout. Your order will be processed once we have received your payment.

We may refuse or cancel an order in certain situations, for example when a product is out of stock, when there is an obvious pricing error, or when we suspect fraud. If this happens after you have paid, we will contact you and refund the full amount as soon as possible.

You agree to provide complete and accurate information when placing an order, including your name, email address, phone number and delivery address, and to let us know straight away if any of these details change.

SECTION 7. SHIPPING AND DELIVERY

We only deliver to addresses in the Netherlands. Our orders are shipped from our partner warehouses in Germany or France.

You can choose between two shipping options at checkout:

Free standard shipping: free of charge, with an estimated delivery time of 4 to 5 business days.

Insured express shipping: €4.95, with an estimated delivery time of 2 to 3 business days. This option includes shipping insurance and faster handling of your order.

Delivery times are estimates and start from the moment your order is shipped. Busy periods, public holidays or delays with the carrier can sometimes cause a delay. If your order is going to take much longer than expected, we will let you know.

The risk of loss or damage to your order passes to you once the parcel has been delivered to you or to a person you have chosen. If your parcel is lost or arrives damaged, please contact us at support@brunetix.com within a reasonable time and we will help you find a solution.

Please make sure your delivery address is correct. If a parcel cannot be delivered because of an incorrect or incomplete address, we may charge the cost of sending it again.

SECTION 8. RIGHT OF WITHDRAWAL AND RETURNS

As a consumer, you have the right to cancel your order within 14 days without giving a reason. This period starts on the day you, or someone you have chosen, receives the product. If your order arrives in more than one delivery, the period starts on the day you receive the last item.

To cancel your order, please send us a clear message by email to support@brunetix.com within these 14 days, stating your name, order number and the products you want to return. We will then send you the return instructions and the return address.

You must send the products back within 14 days after telling us that you want to cancel. Unless stated otherwise, the cost of returning the products is paid by you.

Please handle the products carefully during this period. You may inspect them in the same way you would in a shop, but if a product has been used, damaged or is missing parts, we may deduct the loss in value from your refund.

We will refund the amount you paid, including the original standard shipping costs, within 14 days of receiving your cancellation. We may wait with the refund until we have received the products back or until you have shown proof that you sent them. If you chose insured express shipping, only the cost of standard shipping is refunded. We refund using the same payment method you used for your order, unless we agree otherwise.

SECTION 9. DEFECTS AND COMPLAINTS

All our products come with your legal rights under Dutch law. This means a product must meet the expectations you may reasonably have of it.

If a product arrives damaged, is defective, or is not what you ordered, please contact us at support@brunetix.com as soon as possible, ideally with your order number and a few photos. We will then repair or replace the product, or refund you, depending on the situation.

We aim to respond to every complaint within 14 days. If you are not satisfied with how we handled your complaint, you may take the matter to the competent court.

SECTION 10. ACCURACY OF BILLING AND ACCOUNT INFORMATION

We may refuse or cancel an order where we believe it was placed by a dealer, reseller or distributor, or where the order information appears to be false. If we make a change to or cancel an order, we will try to contact you using the email address or phone number you gave us.

SECTION 11. THIRD PARTY TOOLS AND LINKS

Our website may give you access to tools or links from third parties, such as payment providers or carriers. We do not control these services and are not responsible for their content, accuracy or availability. Your use of third party services is at your own risk and is subject to the terms of those third parties.

SECTION 12. REVIEWS, COMMENTS AND FEEDBACK

If you send us reviews, ideas, suggestions or other feedback, we may use, edit and publish them without any obligation to pay you or keep them confidential.

You agree that your comments will not be unlawful, offensive, misleading or harmful, and that they will not contain viruses or other harmful code. You may not use a false email address or pretend to be someone else. We may remove any content that we find unlawful, offensive or otherwise inappropriate.

SECTION 13. PERSONAL INFORMATION

The personal information you share with us when using our store is handled in line with the General Data Protection Regulation (GDPR) and our Privacy Policy.

SECTION 14. ERRORS AND OMISSIONS

Occasionally our website may contain typing errors, inaccuracies or omissions in product descriptions, prices, promotions, shipping times or availability. We may correct these at any time. If an obvious error affects your order, we will contact you and you may choose to cancel it for a full refund.

SECTION 15. PROHIBITED USES

In addition to the other rules in these terms, you may not use our website or its content:

for any unlawful purpose or to encourage others to act unlawfully;

to break any international, national or local laws or regulations;

to infringe our intellectual property rights or those of others;

to harass, abuse, insult, harm, threaten or discriminate against anyone;

to submit false or misleading information;

to upload or send viruses or any other harmful code;

to collect or track other people's personal information;

to send spam, phishing messages or similar content;

to interfere with or get around the security features of our website.

We may stop your use of our website if you take part in any of these prohibited uses.

SECTION 16. LIABILITY

We do our best to keep our website available and free of errors, but we cannot guarantee that it will always work without interruption.

We are not liable for indirect damage, such as lost profits or consequential loss, arising from the use of our website or products, unless this damage is caused by intent or gross negligence on our part. Our total liability for any order is limited to the amount you paid for that order.

None of this limits your rights as a consumer under Dutch or European law, or our liability where it cannot be excluded or limited by law.

SECTION 17. INDEMNIFICATION

You agree to compensate us for any claims or costs, including reasonable legal fees, made by third parties because you broke these terms or the law.

SECTION 18. SEVERABILITY

If any part of these terms is found to be invalid or unenforceable, that part will be replaced by a valid provision that comes as close as possible to the original intention. The rest of these terms will remain in full force.

SECTION 19. TERMINATION

These terms apply until they are ended by you or by us. You may end them at any time by no longer using our website. Obligations and liabilities that arose before termination will continue to apply.

SECTION 20. ENTIRE AGREEMENT

These Terms of Service, together with any policies published on our website, form the full agreement between you and Brunetix regarding the use of our website and the purchase of our products.

SECTION 21. GOVERNING LAW

These terms and any agreement between you and Brunetix are governed by Dutch law. Any disputes will be brought before the competent court in the Netherlands. As a consumer, you keep the protection given to you by the mandatory laws of the country where you live.

SECTION 22. CHANGES TO THESE TERMS

We may update these Terms of Service from time to time. The latest version will always be available on this page. The terms that apply to your order are the terms that were published at the moment you placed it.
